This Services Agreement (the “Agreement”) contains the complete terms and conditions which govern your use of Web hosting, Domain Registrations, e-commerce, Dedicated Servers, and other services provided by RANKWEBHOST (the “Services”). In this Agreement, “RANKWEBHOST Pakistan”, “Hosting Provider”, “we”, “us” means RANKWEBHOST Pakistan and “Client”, “Subscriber”, “you”, or “your” means you. By clicking on the “Submit Order” button, or by buying any of our hosting package, you acknowledge that you have read the Agreement, and you agree to its terms, conditions and all policies of RANKWEBHOST. Failure to comply with these terms and conditions may result in account suspension or termination, the determination made at the sole discretion of RANKWEBHOST, on a case-to-case basis.
In addition to the following, the Acceptable Use Policies provide more detailed information regarding what is acceptable use of our products and services.
Refund / Money back Policy
All new web hosting orders for shared hosting include a 30 days refund / money back guarantee. Please find below our refund policy for different services / products offered by RANKWEBHOST:
- Hosting Refund Policy
If you become unsatisfied at any point within the first 30 days usage, we will offer full refund of the amount paid for hosting. Refund requests should state clearly the reason for your refund request and must be received within the 30 days of activation through email or Support. - Domain Refund Policy
RANKWEBHOST uses third party domain registrar to register the domains, so once registered domain’s registration cost will not be included in the refund. However you will be able to retain the ownership of domain, and will be eligible to transfer your domain to other registrars. - Other Important Info
Accounts terminated due to violation of our terms and conditions found below, will not be eligible for the refund. - Non-refundable Products and Services.
Refunds are not offered on VPS / dedicated servers orders.
Acceptable Usage and Content Policy
RANKWEBHOST strictly prohibits any account hosted on our servers from containing certain types of material. These include, but are not limited to:
- Adult Material
This includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of “adult material” is left entirely to the discretion of RANKWEBHOST. - Illegal Material or Activity
This includes any material considered illegal by the governing body e.g. commercial music, audio, video files, copyrighted material. Investment Sites (FOREX, E-Gold Exchange, Second Line/Linden Exchange, Ponzi, High-Yield Interest Programs (HYIP) or Related Sites, MLM/Pyramid Scheme). Sale of any controlled substance without prior proof of appropriate permit(s). Proxy Scripts/Anonymizers. Anonymous or Bulk SMS Gateways. Torrent application, tracker or client. - Warez
This includes pirated, nulled, hacking, ip spoofing, password cracking scripts or software. - Questionable Material
This includes any material, which is meant to harm, bash, offend, or pull down another group, be it political, religious, racial, sexual, or otherwise.
ICANN Registrant Rights and Responsibilities
RANKWEBHOST Pakistan strives to ensure the domain Registrants and Resellers need are always fulfilled. You can view this page to read the ICANN’s directions and policies on your rights and responsibilities as Registrant of domain.
UCE (Unsolicited Commerce Email) – SPAM Policy
Spamming is the sending of unsolicited e-mail, to persons the sender does not know or have prior consent to send the message to. We have a very strict spam protection policy. This also includes sending unsolicited advertisements to newsgroups, email addresses and/or generating a high volume of outgoing email. There are many ways that someone can hide their identity on the Internet, and we are aware of these ways, so be assured that your account would not be terminated until we are not fully sure that they have indeed abused our services. Sending mails through script should always be less than 500 in an hour, consistent violation of this limit will result in account suspension. Also you should script your emails to be sent in intervals of at-least 7 to 10 seconds apart so there is not undue load on the server. Any account found in violation of this will be cancelled immediately.
Please report any instances of spamming to SUPPORT@RANKWEBHOST.COM, with as much details as possible, by clearly identifying the source of the spam email account.
Disk Space Abuse
The space we provide for hosting should not be used as a storage medium for your files or data. At least 90% of your web pages must be ‘linked’ with files (GIF, JPEG, etc.) stored on RANKWEBHOST servers. Website that are found to contain either/or no HTML documents, a large number of un-linked files are subject to files deletion or account cancellation.
Account Resources Abuse
Continuous overuse of server resources may also result in account suspension / termination. Any account using 25% CPU / Memory resources for more than 60 seconds, resulting from the single or combined use of FTP, CGI Scripts, HTML or MySql resources will result in account suspension.
Technical Support Boundaries
RANKWEBHOST provides technical support for you that encompasses within our area of expertise only. Such expertise includes assistance, installation, troubleshooting, and debugging, and any other hosting related issues. However, in under no circumstances is RANKWEBHOST neither obligated to help you in providing assistance for any coding related issues, errors produced by any applications, unless our support team in its sole discretion is willing to do so.
Disclosure to Law Enforcement
Our acceptable usage policy specifically prohibits the use of our service for illegal activities. Therefore, Subscriber agrees that the RANKWEBHOST can disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the client. In addition RANKWEBHOST shall have the right to terminate all service set forth.
Legal Threats & Non-professional Behavior
We at RANKWEBHOST are here to help you and provide the best possible service. However any unreasonable threats, either personal or against RANKWEBHOST will receive a warning for breach of these conditions. Personal abuse towards RANKWEBHOST employees or legal threats against the company are viewed as extremely serious. RANKWEBHOST reserves the right to refuse to do business with a person or company as a result and possibly terminate any accounts in question.
Changes to the Agreement or the Services
RANKWEBHOST may modify, add, or delete portions of this Agreement at any time. If we have made significant changes to this Agreement, we will indicate it at the top of this Agreement with the date of the last revision and a link to previous terms for up to 30 days. Any revisions to this Agreement will become effective when posted unless otherwise specified. You agree to any modification to this Agreement by continuing to use the Services after the effective date of any such modification.
RANKWEBHOST reserves the right to modify, change, or discontinue any aspect of the Services at any time.
Backups and Data Loss
You use our services on your own sole risk. RANKWEBHOST is not responsible for files, data residing on your account. YOU AGREE TO TAKE FULL RESPONSIBILITY FOR FILES AND DATA TRANSFERRED AND TO MAINTAIN ALL APPROPRIATE LOCAL BACKUPS OF FILES AND DATA STORED ON RANKWEBHOST SERVERS.
Disclaimer of Warranty
RANKWEBHOST INTERNET SERVICE, INCLUDING WITHOUT LIMITATION, ALL PRODUCTS AND SERVICES AND ALL TEXT, GRAPHICS, LINKS ARE PROVIDED TO CLIENT ON AN ‘AS IS, AS AVAILABLE’ BASIS AND WITHOUT WARRANTY OF ANY KIND. NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE OF MERCHANT-ABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE WITH RESPECT TO RANKWEBHOST OR ANY INFORMATION OR SOFTWARE THEREIN.
Limitation of Liability
YOU RELEASE RANKWEBHOST FROM ANY LIABILITY OR RESPONSIBILITY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGE SUFFERED BY YOU RELATED TO YOUR USE OF OR INABILITY TO USE WEBHOST.MUBASHIRALI.COM SERVICES INCLUDING, BUT NOT LIMITED TO, DAMAGE FROM LOSS OF DATA RESULTING FROM DELAYS, SERVICE INTERRUPTIONS, MISS-DELIVERIES, NON-DELIVERIES, OR DUE TO INADVERTENT RELEASE OR DISCLOSURE OF INFORMATION SENT BY YOU EVEN IF THE SAME IS CAUSED BY RANKWEBHOST OWN NEGLIGENCE.
